Wrongful Death settlement in Little Rock

There has been a settlement in a wrongful death lawsuit in Little Rock.

On September 19, 2014 Heather Cater, who was with two friends, had just finished work at the dental office when she was struck and killed by a vehicle driven by Denote Jones as he was fleeing from police.

Plain clothes narcotics officers, James Foster and Adam Robertson were in Walgreens store at University and Asher avenues in Little Rock and noticed 19 year old Jones, standing in line and smelling of marijuana. As the officers watched Jones outside the pharmacy they saw another man getting in and out of his vehicle very quickly therefore leading them to suspect Jones of drug dealing. As other deputies joined in the pursuit Jones fled in his Tahoe vehicle heading the wrong way. Cater was standing beside her car on a narrow raised median and saw Jones’ Tahoe which was being chased by patrol cars moving rapidly toward her. Confused and not knowing which way to go she stepped in to the path of the Jones’ vehicle sustaining spinal and lung injuries which resulted in the death the following morning.

The family of newlywed Cater filed a wrongful death lawsuit, and a settlement has now been reached. The suit accused the Sheriff’s office of allowing its deputies to act irresponsibly in a parking lot where there were several onlookers and failing to weigh up the danger to the public against the severity of the suspected crime.

Jones had been charged with capital murder, delivery of a controlled substance, and leaving the scene of an accident. He will stand trial in Pulaski County Circuit Court.
